Service Terms for Orthos
These Service Terms are an integral part of your agreement with Orthos. Any capitalized terms used but not defined herein shall have the meanings ascribed to them in the overarching Terms. In the event of any conflict between these Service Terms and the Terms, these Service Terms shall prevail with respect to the features and services governed herein.
1. AI HUKUM AND CONTRACT VAULT SERVICES
1.1. Orthos provides AI Hukum and Contract Vault (AI-powered contract review) services ("Services") to assist Users in legal analysis and document review.
1.2. Users acknowledge that the Services are intended to provide guidance and support but do not constitute legal advice. Users are encouraged to consult with a qualified legal professional for specific legal matters.
1.3. Orthos disclaims any liability for actions taken or not taken based on the information provided through the Services.
2. DATA STORAGE LOCATION
2.1. By default, Customer Data is stored within the Jakarta region of Indonesia, in compliance with applicable Indonesian laws and regulations. While Orthos does not hold a license from the Otoritas Jasa Keuangan (OJK), we are committed to adhering to relevant data protection and privacy laws, including Undang-Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi.
2.2. Where supported by our underlying cloud service provider(s) and in compliance with applicable laws and regulations, you may request to have your Customer Data stored outside of Indonesia. Orthos will use commercially reasonable efforts to accommodate such requests.
2.3. You acknowledge that storing Customer Data outside of Indonesia may impact the performance and availability of the Services.
2.4. You further acknowledge that processing of Customer Data may still occur within the United States or other jurisdictions, and you consent to such processing.
3. USER RESPONSIBILITIES
3.1. Users agree to provide accurate and complete information when utilizing the Services and to ensure that the Data stored does not violate any applicable laws or regulations.
3.2. Users shall maintain the confidentiality of their account information and promptly notify Orthos of any unauthorized use of their account.
4. DATA PROTECTION AND PRIVACY
4.1. Orthos is committed to safeguarding the privacy and security of User Data. We adhere to the principles of confidentiality and data security, ensuring that User Data is protected against unauthorized access, loss, or destruction.
4.2. Ownership of Data: Your data is yours. Orthos does not train on your data, and it is not used to train models for others. You retain full ownership and control over your data.
4.3. Control Over Data: You have the right to request the deletion of your data at any stage. Orthos will comply with such requests in accordance with applicable laws and regulations.
4.4. Transparency: Orthos is committed to clear communication regarding your data. We will inform you simply and transparently about how your data is used, stored, and processed.
4.5. User Rights: In accordance with the latest data privacy law, you have the right to access, correct, and delete your personal data. You may also withdraw your consent for data processing at any time.
4.6. Orthos will not disclose User Data to third parties without prior consent, except as required by law.
5. LIMITATION OF LIABILITY
5.1. To the maximum extent permitted by law, Orthos shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Services, including but not limited to loss of data or profits.
6. CHANGES TO TERMS
6.1. Orthos reserves the right to modify these Service Terms at any time. Users will be notified of any changes, and continued use of the Services constitutes acceptance of the new terms.
7. GOVERNING LAW
7.1. These Service Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia.
